Terms of Service

1. Operator Identity

CraftLingua is a software-as-a-service product operated by SP Digital LLC, a limited liability company incorporated in the State of Wisconsin, United States ("SP Digital," "we," "us," or "our"). References to "CraftLingua," "the Service," or "the Platform" in these Terms refer to the website and application available at craftlingua.app and any related subdomains.

2. Acceptance of Terms

By accessing or using CraftLingua you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the Service. Your continued use of the Service following any updates to these Terms constitutes acceptance of the revised Terms.

3. Description of Service

CraftLingua provides an interactive language creation wizard that allows users to construct fictional or constructed languages (conlangs) by selecting phonological, morphological, lexical, semantic, and pragmatic parameters. The Service generates sample vocabulary, grammatical rules, and translations for creative and educational use.

4. Accounts and Eligibility

You must be at least 13 years old to create an account. By registering, you represent that you are of sufficient legal age and that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Subscription and Billing

CraftLingua offers a free tier and paid subscription tiers (Linguist and Archmage). Paid subscriptions are billed on a monthly basis. All payments are processed by Stripe, Inc. in accordance with Stripe's terms and policies. By subscribing to a paid tier, you authorize SP Digital LLC to charge your payment method on a recurring basis.

Subscriptions may be canceled at any time through the billing portal. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time unless required by applicable law. SP Digital LLC reserves the right to change pricing with reasonable advance notice.

6. Intellectual Property

Platform: The CraftLingua platform, including its software, algorithms, design, branding, and all original content created by SP Digital LLC, is the exclusive property of SP Digital LLC and is protected by applicable copyright, trademark, and other intellectual property laws.

User-Created Languages: You retain full ownership of the language configurations and content you create using the Service. By using the Service, you grant SP Digital LLC a limited, non-exclusive license to store and process your language data solely for the purpose of providing the Service to you.

Third-Party Attribution: The Service's footer quote contains dialogue from Star Trek VI: The Undiscovered Country (1991). SP Digital LLC acknowledges the film's original dialogue and makes no claim of ownership over the underlying source material. Additional inspiration is drawn from established linguistic theory and the broader world-building community.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SP DIGITAL LLC MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE LINGUISTIC ACCURACY, COMPLETENESS, OR SCHOLARLY VALIDITY OF ANY LANGUAGE CONTENT GENERATED BY THE SERVICE. Generated language content is intended for creative and educational purposes only and should not be relied upon as authoritative linguistic or academic material.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SP DIGITAL LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SP DIGITAL LLC'S TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SP DIGITAL LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

9. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Infringe any third-party intellectual property rights.
  • Transmit harmful, offensive, or malicious content.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Resell or sublicense access to the Service without prior written consent from SP Digital LLC.

10. Termination

SP Digital LLC reserves the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us at the address below.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.

12. Changes to Terms

SP Digital LLC may update these Terms from time to time. We will notify you of material changes by posting the new Terms with an updated effective date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
